Terms
& Conditions for Accessing SIRCA Data
Your use of this site, the data contained within this site, the
data referred to on this site which is downloaded for your use by
SIRCA and the project results, reports or publications arising from
the use of the data available on this site are subject to the following
terms and conditions:
- Researchers who receive data must use it for academic research
purposes only. Data is not to be used for any commercial purpose
nor is any data received or obtained from SIRCA to be on sold
or otherwise provided to a third party. Any proposal to commercialise
any of the results of the academic research that use SIRCA data
must be approved by SIRCA and/or the providers of the data prior
to commencing any commercialisation activity.
- Members who obtain or receive this data must establish internal
security procedures to prevent any unauthorised access to the
data. It is recommended that data stored on central systems be
subject to encryption.
- Members will be responsible for ensuring that any students,
staff etc given access to the data for the sole purpose of the
Project keep the data confidential.
- Data provided by SIRCA for a particular Project is not to be
used for any other project or purpose without the prior approval
of SIRCA.
- All reports, papers or Project outcomes, which make use of Confidential
Data, are to be submitted to SIRCA at least 50 days prior to publication.
SIRCA will notify both the Member and the author of any amendments,
which need to be made pursuant to the obligations agreed to by
both parties at the time that the Project was approved. This provision
is designed to ensure that any reports do not disclose any sensitive
or Confidential Data.
- Should the project outcome be greater than 10 pages in length,
an Executive Summary must be provided to SIRCA along with the
Project Outcome.
- Acknowledgement: Please acknowledge the use of SIRCA data in
all research papers and reports as follows. "Data
supplied by Securities Industry Research Centre of Asia-Pacific
(SIRCA) on behalf of XXX (data provider eg. ASX, Reuters, SFE,
Aspect Financial, NZSE)."
- Copies of any reports, papers or any other Project outcomes
are to be provided to SIRCA within 10 days of completion of the
Project. Including but not limited to any interim results from
the Project.
- SIRCA will be given joint publication rights for all reports,
papers and Project Outcomes, [regardless of whether the author
or the relevant Member intends to publish]. In addition you consent
to SIRCA making any reports, papers or Project Outcomes publically
available. SIRCA intends to compile such papers, reports or Project
Outcomes into a database, which will be capable of being publically
accessed.
- All reports, papers or Project outcomes whether intended for
publication or not are required to acknowledge SIRCA and the relevant
data provider for example, the Australian Stock Exchange Limited,
The SFE Corporation Limited, Reuters Limited.
- The content of this site, including all information such as
text, graphics, tables, images or other material (“Material”)
is protected by Australian and international copyright law.
- SIRCA makes no representations about the accuracy, reliability,
completeness or quality of the Material. The Material may contain
errors, omissions or any other such errors. As such the use of
the site and any data contained within it are at the users own
risk.
- SIRCA, nor any third parties contributing to the data provided
on the site, will not be liable for any loss or damage whatsoever,
(including without limitation, incidental and consequential damages)
resulting from the use or access of or inability to use and access
the site and any of the Material contained within it.
- The user indemnifies SIRCA against all losses and liabilities
incurred by SIRCA, and all legal costs and other expenses incurred
by SIRCA in connection with a demand, action or other proceeding
arising as a result or a breach of any of the Terms and Conditions.
- These Terms and Conditions may be amended or updated from time
to time.
- The Terms and Conditions are governed by and construed in accordance
with the laws of New South Wales and as such any user irrevocably
and unconditionally submits to the exclusive jurisdiction of the
courts of New South Wales.
For the purposes of the Terms and Conditions, the
term “Project” is a reference to the Project outlined
in the Data Consult Form. For the purpose of the Terms and Conditions,
the term “Confidential Data” is a reference to “data
which includes but is not limited to all SIRCA data, software products,
research, information and materials whether provided verbally, in
electronic form, in writing or such other form by SIRCA, development,
trade secrets and/or business affairs of SIRCA, its employees, customers,
subsidiaries, affiliates and agents.”
